A person may still be able to invoke the Fifth Amendment if answering could expose them to: ● Prosecution for different federal crimes that were not pardoned, ● State crimes, because a presidential pardon does not erase state criminal liability, ● Crimes committed after the pardon or outside its scope, ● Or other truthful answers that could provide evidence leading to prosecution for unpardoned offenses.
