➡️ Next steps for the Clarity Act... (There is a lot of misinformation out there) 🔹 Senate negotiations (current stage) The House has already passed its version of the CLARITY Act. The Senate has spent the past several months producing its own version through the Senate Banking and Agriculture Committees. Negotiators have been working to resolve remaining issues, including ethics provisions, AML/KYC requirements, and enforcement language. Recent reports indicate that negotiators have made progress on an ethics compromise, but the final legislative text still needs to be released publicly. 🔹 Senate floor debate Once Senate leadership schedules the bill, it will be debated on the Senate floor. Senators can offer amendments unless debate is limited. 🔹 Cloture vote (60 votes required) Because this is ordinary legislation, it must overcome a filibuster. That means 60 senators must vote for cloture to end debate. Republicans alone do not have 60 votes, so bipartisan support is required. This has been the bill's biggest hurdle. 🔹 Final Senate passage If cloture succeeds, the Senate votes on final passage. A simple majority is then sufficient. 🔹 Resolving House–Senate differences If the Senate passes a version that differs from the House bill, which is expected, the two chambers must agree on identical text. This can happen either through: ⚪️ a conference committee, or ⚪️ the House voting to accept the Senate's amendments. 🔹 Presidential signature Once both chambers pass the exact same bill, it goes to the President, who can sign it into law or veto it. ➡️ We have 12 business days to get this out of negotiations, floor debate, cloture vote, reconciliation of both version (House and Senate), then finally the presidents signature. The timeline to get this passed prior to August recess is getting slimmer and slimmer. Releasing of the text with ETHICS, DEFI, and AML/CTF provisions is a step in the right direction.
