Case Comment; Yehudit Solomon vs Aynalem Worku File No. 180281
I. Summary of Facts
The dispute arise on the inheritance rights claimed by Woizero Yehudit Solomon, who seeks to inherit the estate of the late Woizero Maseret Welediyab, through her father, whom she alleges is the biological child of the deceased. The applicant claims that her father’s blood relationship with the deceased had been previously acknowledged and documented by a woreda court decision. Based on this, she applied for recognition as a legal heir. However, the respondent, Woizero Aynalem Worku, challenged this claim, asserting that the applicant’s father was never legally or biologically acknowledged as the child of the deceased, and therefore, Yehudit has no legitimate succession rights. This claim led to a chain of litigation across four levels of courts in Oromia and a final review by the Federal Supreme Court Cassation Bench.
II. Legal Issues

2. Whether the applicant, as a descendant of the alleged child, qualifies as a rightful heir under Ethiopian succession law.
3. Whether the lower courts committed fundamental legal errors in interpreting the legal relationship between filiation and inheritance.
III. Synopsis of Court Judgments
Woreda Court (First Instance) of Oromia
The woreda court recognized Yehudit’s claim, accepting testimony and documents submitted in support of her father’s filial link to the deceased. It ordered that Yehudit was entitled to share in the inheritance as a representative heir.
Zonal High Court of Oromia
The zonal court reversed the woreda court’s decision, emphasizing that the alleged filiation was not substantiated by formal legal documentation such as a birth certificate, court judgment, or official acknowledgment. The court held that inheritance could not proceed without establishing this foundational legal relationship.
